User Agreement

Following is a summary of the terms and conditions that apply to all purchases made from Flowers with Essence.

Orders and Deliveries:

1. Any deliveries that are for private residencies or units/apartments, townhouses, a contact phone number for the recipient must be provided. We will contact the recipient discreetly to organise convenient time of delivery. If we have organised a delivery time with the client or the recipient and no one is at the delivery address and we have nowhere safe to leave the flowers, an additional fee will apply for the flowers to be returned to our store and then re-delivered the next day.
2. If payment is made directly to the Flowers with Essence Bank Account, the flower request will be sent to the recipient after the transaction is visible on our bank statement. Basically we will not send the flowers until we see payment on our statement.
3. Flowers are seasonal and colours of flowers and specific products may also subject to availability on the day. If the client would like the exact flowers they have ordered on - line, contact must be made Flowers with Essence prior to the delivery day, to ensure the flowers are available or to give Flowers with Essence a few days’ notice to order the exact flowers required to fulfil their request. 

Returns and Refunds:

A request for a refund would require the client/ recipient to send a picture of the flowers to us within 24hrs of receiving them.  We can then either send out another bunch of flowers to the same value or refund the customer. 

Prices, Payment & Credit Card Information

For each order, you must pay:

• the applicable price for the relevant services confirmed by Flowers with Essence which may include a deposit related to the provision of Professional Services; and
• the delivery and handling fee specified on the web site at that time if required; and
• any applicable taxes such as Goods and Services Tax in Australia.

Your order and credit card details are safe and secure. All personal and credit card information provided to Flowers with Essence is encoded using Secure Sockets Layer (SSL) technology, an encryption protocol that protects data as it travels over the Internet. We only accept payments using the methods stated in the orders & payment section of this website.

You credit card information will be processed by the payment provider that you select during the check-out process. All payment providers used by Flowers with Essence are PCI DSS Compliant. Flowers with Essence is also PCI DSS Compliant. Flowers with Essence will not store your credit card data in our website or web servers.

Payment must be cleared before the services are dispatched unless you have approved credit facilities with Flowers with Essence.

Flowers with Essence maintains a Privacy Policy that defines what we will do with your personal information.

Products and Services

Our products and services include providing flower bouquets, vase arrangements, box arrangements, event/wedding and functions flowers, funeral arrangements, gifts, hampers, consultations, costing quotes and fees

Your Account

You agree to take responsibility for the safekeeping of your user name and password. You are liable if your user name or password is used by an unauthorised person. You agree to release and indemnify Flowers with Essence in connection with any use (whether authorised or unauthorised) of your user name or password. Flowers with Essence may suspend or cancel your account at any time without prior notice.

Images and specifications

Images that are displayed on the Flowers with Essence websites are for informational and marketing purposes and do not represent the actual contents of a product or service. Please refer to the detail product description and the Additional Product Information for specifications. The features and functions of individual products may be changed or updated from time to time.

Privacy

Flowers with Essence will comply with Flowers with Essence Privacy Policy. Flowers with Essence will not reveal your personal information to external organizations except for the purposes of fulfilling your order.

Liability

Any liability of Flowers with Essence in connection with goods or services supplied to you will, subject to any non-excludable liability for breach of conditions or warranties implied by legislation and to the maximum extent permitted by law, at the election of Flowers with Essence be limited to: 1. in relation to goods, the replacement of the goods or the supply of equivalent goods; and 2. in relation to services, the supplying of the services again or the payment of the cost of having the services supplied again.

Changes To Terms

Each order is governed by the terms and conditions current when the order is placed. Flowers with Essence may add to, delete or otherwise change these terms and conditions without notice. It is your responsibility to read and understand these terms and conditions each time you place an order.

Applicable Law

All purchases, and these terms and conditions, are subject to the laws of New South Wales, Australia.

Credit Card Data and PCI DSS Compliance

Flowers with Essence hosting environment and ecommerce software packages are Payment Card Industry Data Security Standard (PCI DSS) compliant, you can find out more from their website at www.pcisecuritystandards.org.

Our website and hosting service provider undergoes an annual PCI compliance review using a Qualified Security Audit company which is BEA Systems. 

PCI DSS requires that you do not store credit card data unencrypted on your website. This includes where credit card information might be added to notes on orders or customer records. Flowers with Essence will scan for credit card data on a regular basis and hash out (destroy) the card number that is stored. Flowers with Essence reserves the right, without recourse, to take offline any online store that is found to be storing credit card data until the situation has been rectified.
